{"id":9013,"date":"2026-08-10T21:09:13","date_gmt":"2026-08-10T21:09:13","guid":{"rendered":"https:\/\/ftsmockup.colincecil.com\/?page_id=9013"},"modified":"2026-08-11T20:41:04","modified_gmt":"2026-08-11T20:41:04","slug":"special-education-code","status":"publish","type":"page","link":"https:\/\/ftsmockup.colincecil.com\/index.php\/departments\/special-services\/special-education-code\/","title":{"rendered":"Special Education Code"},"content":{"rendered":"<p>\n<img decoding=\"async\" src=\"https:\/\/3.files.edl.io\/bcf9\/25\/09\/10\/142048-eead321c-c224-4d81-8ac1-311ac455c5f4.png\" alt=\" kkkk\"><\/p>\n<h2>Overview of Eligibility Requirements<\/h2>\n<p>Under New Jersey Administrative Code Title 6A, Chapter 14, students between the ages of 3 and 21 are eligible for special education and related services if they meet the criteria for one or more of fourteen recognized disabilities.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/3.files.edl.io\/d186\/25\/09\/10\/142753-f2467224-3759-4b4e-b713-7eaf2de421dd.png\" alt=\"\"><\/p>\n<p>A meeting is held to determine eligibility for special education and related services, and parents must receive the evaluation documentation at least 10 calendar days beforehand.<\/p>\n<p>To be deemed eligible and classified as &#8220;eligible for special education and related services,&#8221; three criteria must all be met:<\/p>\n<ol>\n<li>\n<p>The student has <strong>one or more<\/strong> of the fourteen specifically defined disabilities (see below).<\/p>\n<\/li>\n<li>\n<p>The disability <strong>adversely affects<\/strong> the student&#8217;s educational performance.<\/p>\n<\/li>\n<li>\n<p>The student <strong>needs<\/strong> special education and related services. <\/p>\n<\/li>\n<\/ol>\n<p>Importantly, eligibility cannot be determined if the student&#8217;s difficulties are primarily due to:<\/p>\n<ul>\n<li>\n<p>A <strong>lack of instruction<\/strong> in reading (including essential components) or mathematics, or<\/p>\n<\/li>\n<li>\n<p>Being a <strong>multilingual learner (ELL)<\/strong> whose challenges stem from language proficiency rather than a disability.<\/p>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.nj.gov\/education\/code\/current\/title6a\/chap14.pdf\" target=\"_blank\" rel=\"noopener\"><strong>N.J.A.C. 6A:14 &#8211; Special Education Code<\/strong> (PDF) <span class=\"ext\" aria-label=\"opens in a new tab\">(external)<\/span><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Overview of Eligibility Requirements Under New Jersey Administrative Code Title 6A, Chapter 14, students between the ages of 3 and 21 are eligible for special education and related services if they meet the criteria for one or more of fourteen recognized disabilities.
